Your use of the Realish News website and services (collectively, the "Services") is at your sole risk. The Services are provided on an "as is" and "as available" basis. Realish News and its affiliates, agents, and partners (collectively, the "Realish News Parties") expressly disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Realish News does not control or endorse user-generated content or external websites linked from our Services and disclaims responsibility for such content. Additionally, Realish News is not responsible for the accuracy, legality, or quality of advertisements or sponsored materials displayed on the Services.
Realish News makes no guarantees that: (a) the Services will meet your expectations; (b) the Services will be uninterrupted, timely, secure, or error-free; (c) the results from using the Services will be accurate or reliable; or (d) any content, products, or information accessed through the Services will meet your standards.
Limitation of Liability
You acknowledge and agree that the Realish News Parties will not be liable for any indirect, incidental, special, consequential, exemplary damages, or damages for loss of profits, goodwill, use, data, or other intangible losses (even if advised of the possibility of such damages), arising from: (a) your use or inability to use the Services; (b) unauthorized access to or alteration of your data; (c) third-party conduct or statements on the Services; or (d) any other issue related to the Services. The total liability of the Realish News Parties for any claims, losses, or damages will not exceed one hundred dollars ($100).
In some jurisdictions, certain disclaimers or limitations of liability may not apply. If any portion of this section is found invalid, the remaining portions will remain enforceable to the extent permitted by law. If you are dissatisfied with the Services or these Terms of Service, your only remedy is to stop using the Services.
If you are a user from New Jersey, the "Disclaimer of Warranties" and "Limitation of Liability" sections are intended to be as broad as permitted under New Jersey law. If any part of these sections is invalid under New Jersey law, the remaining parts will remain valid.
Termination
Realish News may, at its discretion, suspend or terminate your account or access to the Services for any reason, including if we believe you have violated these Terms of Service or engaged in fraudulent, abusive, or illegal activity. Such activities may be reported to law enforcement. Realish News may also discontinue the Services at any time without notice. Termination may involve deactivating or deleting your account and barring further access to the Services. Realish News will not be liable for any consequences of termination.
General
These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Realish News regarding the Services, superseding any prior agreements. Additional terms may apply when using third-party services or content. These Terms of Service are governed by Illinois law, excluding its conflict of law provisions. Any disputes will be resolved in state or federal courts in Cook County, Illinois. Failure to enforce any provision does not waive it. If any provision is invalid, the remaining provisions remain in effect. Claims related to the Services must be filed within one (1) year. The prevailing party in legal actions may recover costs and reasonable attorney fees. Printed versions of these Terms of Service are admissible in legal proceedings. You may not assign these Terms of Service without Realish News's consent, but Realish News may assign them without restriction. Notices may be sent via email or regular mail, or posted on the Services. Realish News is not liable for delays or failures due to events beyond its control, such as natural disasters, civil disturbances, or technical issues.
